CMSQUARE's customized services:

Bid/Tender Advisory

CMSQUARE offers customized assistance to its clients during the preparation phase of bid/tender, including drafting of bespoke general conditions and special conditions of contract, review of contract technical documentation for completeness and compatibility with the conditions of contract under the applicable law.

CMSQUARE equally supports contractors preparing bids for complex international projects, including assessing risks in the general and special conditions of contract, bid review for completeness of scope, drafting of clarification questions, contract negotiation and drafting of final clarifications for inclusion in contract documents.

Project Consultancy

Construction and infrastructure projects are complex and the contractor’s performance is often below expectations. Chronic disputes with owners/employers, suppliers and subcontractors as well as unexpected outcomes to measures taken during the execution of the works are all indicators of uncontrolled deterioration of the project situation. Poor management of any of these aspects may lead to unnecessary delays, claims and disputes and eventually higher costs. Project Assessments and Contractual Audits CMSQUARE’s solutions are highly customized to meet the individual needs of its clients by means of assessment and/or audits of project procedures; this allows determining the likely cause of problems, identifying high risk in projects during the bid, planning and execution phase and offering pragmatic advice in order to accentuate management’s awareness of these projects. Project Support Services CMSQUARE has extensive experience in providing high-value services in international projects. Our portfolio of advisory services covers specific assistance in reviewing contracts for potential risk exposures, preparation of key documents and correspondence, contract management support in drafting requests for extension of time or contractual adjustments, as well as support in the preparation and conduct of alternative and judicial dispute resolution procedures.

CMSQUARE also provides on-call support and advice during the project’s execution phase in relation to contractual interpretation and drafting of contractual letters. These services can be undertaken on an ad-hoc basis and are also suited for long-distance working.

Contract Management

CMSQUARE supports its clients in the preparation, substantiation and negotiation of claims in order to prevent expensive and time-consuming disputes providing high-value services in:

  • development of the overall claim strategy to help ensure contract compliance in the client’s affirmative claims, as well as in the client’s defence against claims brought against them by other project parties
  • timely response to change order requests, requests for information submissions, and any other claims related correspondence
  • preparation and development of claims including the preparation of related documentation such as delay and cost analyses, supporting data and graphics
  • development and preservation of contemporary records

Dispute Resolution

Alternative Dispute Resolution and Litigation Support

CMSQUARE provides effective support throughout formal dispute resolution processes, assisting with document discovery, claim analysis, deposition preparation, as well as reviewing the opposing party’s claims and expert analysis. In addition, CMSQUARE may assist their client’s legal representatives with the technical understanding required to present the case through the client’s witnesses.
CMSQUARE’s integrated network of dispute resolution services includes:

  • Contract Evaluation
  • Analysis and interpretation of site documentation
  • Damages Quantification
  • Negotiation and Settlement Assistance
  • Dispute Management
  • DAB, Arbitration and Litigation Support

CMSQUARE delivers custom-made as well as standardised training in diverse forms of international construction and supply contracts and offers related courses such as contract administration, claims preparation and evaluation and the full suite of dispute resolution procedures.

Our seminars and webinars are designed with the objective to provide:

  • working knowledge of the basic concepts of contract law and commercial matters related to the project
  • understanding of how to identify the inherent risks to the objectives of the project and creating an awareness among the participants of the contractual mechanisms available to manage the risk effectively
  • working knowledge of the operation of standard forms and bespoke forms of contract terms, procedures and mechanisms including issues such as delays, defects and completion
  • Awareness of the procedures to be followed for change orders and claims
  • working knowledge of how to prepare, present, respond to and administer claims in an effective manner
  • working knowledge of ADR procedures, in particular the preparation of dispute referral, response and reply documents

In order to increase the benefit gained from our trainings, we interact with the clients’ coordinator during the preparation of the seminar/webinar and help to determine specific weaknesses within the clients’ own contract, claims and change order management, and to develop a customized presentation which contributes to maximizing the group participation and skills transfer.
